Acceptable Use Policy

This document determines Edge UOL Acceptable Use Policy (AUP), for each Edge UOL customer and user of Edge UOL broadband network and/or Internet Data Centers (“Customer”). This AUP supersedes any other written or oral policy regarding this issue.

Edge UOL reserves the right to modify this AUP at any time.

The provisions of this AUP are not exhaustive. Any activity or conduct that violates laws, regulations or standards determined by the Internet community, or that may harm Edge UOL facilities, network, reputation, good faith, or customer relations, is strictly forbidden, whether or not expressly mentioned in this AUP.

In the same way, Edge UOL assumes the following commitments to the security and privacy of Users:

Customer’s Content Control

The Customer acknowledges that Edge UOL does not exercise control over of information content originating from stored in or passed through the Customer’s website (s) and that it is the Customer’s entire responsibility to ensure that the information that the Customer and its users transmit, receive or store are in accordance with applicable laws and regulations, and with this AUP.

System and Network Security

Violations of system and network security are prohibited, and such violations may result in criminal or civil liability. Customers may not: (i) adulterate accounts of other customers, (ii) commit unauthorized intrusions into any Edge UOL network or systems; (iii) use any equipment, files, accounts or systems of Edge UOL to invade any other network without authorization; (iv) obtain unauthorized access to or use of data, systems or networks, including any attempt to investigate, examine or test network vulnerability, network devices, or violate security or authentication measures without the express permission of Edge UOL; (v) take advantage of unauthorized monitoring of data or traffic on any network or system without the express authorization of the owner of the system or network; (vi) use Edge UOL services not included in the Customer’s account, or circumvent security (or assist others to circumvent security) to gain access to services for which the person accessing these services has not entered into an agreement with (or connected to) Edge UOL, including, but not limited to, breach of password secrecy and persuasion of third parties for password release; (vii) use the Edge UOL network and systems in a manner that will obstruct disk space, processors, or other system resources in an unreasonable manner, and beyond those permitted for the specific type of customer account. Customers should not make deliberate attempts to interfere with a service, overload a service, or attempt to disable a host, including adhering to denial of service attacks (sending packages with illegal size, UDP flooding, ping-flooding, half-open TCP connection flooding, etc.); or (viii) modify any TCP-IP header or any part of the header information in an email or newsgroup posting. Edge UOL will investigate incidents involving such violations and may involve and cooperate with the force of law if a criminal violation is suspected.

Prohibited Use

It is a violation of these policies if the Customer knowingly uses the facilities or services of Edge UOL, including any Internet access, web site hosting and design services of the Edge UOL website, to create, transmit, distribute, place, store or make available on the Internet any material that is unlawful or in violation of any applicable regulations, or that is abusive or harmful to the facilities, customers, good faith or reputation of Edge UOL. Communications prohibited by this Policy include, but are not limited to: materials that infringe a trademark, trade secret or other intellectual property right; material that violates laws or regulations pertaining to obscenity, indecency, or child pornography; material that is accusatory or defamatory; material that constitutes an illegal threat; and material that violates any applicable import and export control laws and regulations. Although it is not the policy of Edge UOL to monitor, censor or edit information available through its facilities, Edge UOL reserves the right to make the necessary arrangements when it becomes aware of transmissions, announcements or other types of communications that violate this AUP.

E-mail and Usenet

Customers may not: (i) send unsolicited or commercial email to any other Customer account that does not specifically request such information, or so as to generate complaints from those who have received such unsolicited emails; (ii) flood/spam newsgroups with commercial or non-commercial advertisements (iii) continue to send commercial email to those who have requested Customer to cease such communication; (iv) use any Edge UOL service or installation for the composition, storage, distribution or receipt of large amounts of email, abusive email or any form of unsolicited commercial email; (v) transmit obscene, harassing, accusatory, defamatory, threatening, abusive or hateful email to persons who have not consented; (vi) use the account, or connection to the network, to receive responses from messages sent by any other provider that violates the rules of this AUP or those of the origin provider; or (vii) use another site’s mail server to send email without express permission from the website.

Processing

The Customer is responsible for the activities of its customers, representatives or end users and, by accepting the services of Edge UOL, is agreeing to make sure its customers/representatives or end-users follow this AUP. Complaints regarding customers or representatives or end users of a Customer will be directed to the Information Security area to evaluate and take the necessary action. If violations of this AUP occur, Edge UOL reserves the right to terminate (in whole or in part) the services or act to stop violations of this AUP caused by the Customer, when Edge UOL deems it appropriate, without prior notice.

ATTEMPTED VIOLATIONS OR INDIRECT VIOLATIONS OF THIS AUP, ATTEMPTED OR ACTUAL VIOLATIONS BY THIRD PARTIES THROUGH EDGE UOL CUSTOMERS OR A FINAL USER OF THE CUTOMER SHALL BE CONSIDERED AS VIOLATIONS OF THE AUP BY THE CUSTOMER OR END-USER.
